Terms of Services

These Terms of Services (“Agreement”) govern the purchase of the Legacy Publishing Service (“Service”) offered by Happy Dolphin Enterprises LLC, a.k.a. "Legacy Publishing" (“Company,” “we,” “us,” or “our”). By purchasing the Service, you (“Client,” “you,” or “your”) agree to the following terms:

1. Service Description

The Legacy Publishing Service is a premium, full-service book development and publishing package. It includes guidance and support in writing (10x 1:1 sessions) as well as publishing and launching your book to a Bestseller on Amazon's US store (sub category). Not included are editing services.

2. Price & Payment

The total cost of the Legacy Publishing service is $8,000 USD.

Payment is due in full at the time of purchase unless otherwise agreed in writing. We may offer installment plans at our discretion, subject to separate terms.

3. Refund Policy

We offer a 3-day refund period beginning on the date of purchase. If you are not satisfied for any reason within those 3 days, you may request a full refund by emailing us at [email protected].

No refunds will be issued after the 3-day period has elapsed, regardless of usage or participation.

4. Client Responsibilities

You agree to actively participate in the process, provide timely feedback, and deliver any necessary content or approvals. Delays caused by lack of communication or missed deadlines on your part may affect delivery timelines and are not the responsibility of Legacy Publishing.

5. Intellectual Property, Publishing Rights & Book Launch

Legacy Publishing is not a publishing company. We provide expert support to help you write, prepare, and self-publish your book. All books are self-published by the author—typically through Amazon’s Kindle Direct Publishing (KDP) platform or another platforms of your choice.

You, the Client, retain full ownership and copyright of all original content and the completed manuscript. You will receive 100% of all royalty payments directly from the publishing platform. Legacy Publishing does not collect or retain any royalties, rights, or claims to your book.

As part of our service, we will manage and execute your book launch campaign with the goal of achieving bestseller status in at least one subcategory on the Amazon US Store. While bestseller status is based on Amazon’s dynamic ranking system and cannot be guaranteed, we apply proven strategies and methods that have consistently produced this result for our clients.

We may request permission to feature your published book in our portfolio or marketing materials, but only with your express written consent.

6. Limitation of Liability

To the fullest extent permitted by law, Legacy Publishing shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the Service.

7. Modifications

We reserve the right to update these Terms of Sale at any time. Changes will be posted on this page and will apply to future purchases.

8. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the

State of Alabama, without regard to its conflict of law principles. In the event of any dispute arising out of or relating to this Agreement or the services provided, both parties agree to first attempt to resolve the matter informally and in good faith.

If a resolution cannot be reached through informal means, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA)

under its Commercial Arbitration Rules. The arbitration shall take place in Fairhope, Alabama, and the language of the arbitration shall be English. Each party shall bear its own costs, and the decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.

9. Non-Guarantee Clause

While we provide professional guidance and support based on proven strategies, we do not guarantee specific outcomes, such as total book sales, long-term rankings, media coverage, or income generated from your book. Success depends on many factors, including your participation, content quality, niche, and ongoing promotion.

10. Confidentiality

We respect your privacy. Any personal information, manuscript drafts, or proprietary ideas you share with us during the course of our work together will be kept

strictly confidential

and will not be shared with third parties without your permission, unless required by law.

11. Force Majeure

Legacy Publishing shall not be held liable for delays or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor strikes, or internet outages.

12. Entire Agreement

These Terms of Services represent the entire agreement between you and Legacy Publishing and supersede any prior discussions, agreements, or understandings. Any changes must be made in writing and signed by both parties.
